first of all I didnt do this--Secondly, I think twister no matter who is playing is more of a copyright infringement-I mean its twister with sumos playing-i think milton bradley would consider using that themselves were it still promoting twister--thirdly why are david bowie, jimi hendrix, king kong, star wars, an operation shirt which was printed, et flying past the moon with an another alien on his bike, clue, mouse trap, humpty-dumpty, etc, etc, not copyright infringement? you dont know what you are talking about and I will side with Threadless who accepted the submission not you.

Just so you know, simply because threadless puts a design up for voting does NOT mean that they mad e the decision that such a design has passed muster with the lawyers in that they will permit it to be printed. Also, even if a design like this does receive high votes, (which, if this site is now overrun by stoner geeks who didn't get one of these when they were in college back in 1987, it will), then Threadless would likely NOT print it. This is simply because of economics... even if this is in fact a parody, it likely won't be worth it to Threadless to pay the legal fees to fight a cease & desist letter and/or take such a conflict to court. It will be just as easy for Threadless to print the next design that comes along containing a unicorn or a monkey or a panda bear in order to pander to the same mindless 16 year olds now proliferating the Threadless population. Discuss.

HOLD up TrivitsMeBoy I am the one who drew this--It took a few days to do btw and is not simply a cut and paste job- Are you suggesting that Im a stoner geek or pandering to mindless 16 year olds? And where are these shirts that were made back in 1987 when you were in college?
1.I searched on the net before doing this shirt for any smurf parodies and was unable to find anything similar
2.I dont see how incorporating Alice in Wonderland and Hair and mind expansion with the smurfs is mindless.
3. As kindly pointed out by bookemdano, Threadless has printed many shirts which certainly border on copyright infringement--calling home--dark side of the garden-operation needed,you sank my battleship, neon monkey(planet of the apes), the fast supper, dad?,neonmedia2, bleeding sun remix,etc--Because those designs were immensely popular and mine is apparently not does that make it more of a case of copyright infringement?
4.What qualifies you to decide in what case something becomes copyright infringement? Im sorry if you dont like my design as I said I worked hard on it, but when its posted next to the famous image from ET poster (with slight modifications) I find this discussion rather ridiculous.

To those who like it and commented thank you. I dont think any of you are mindless 16 year olds.

everything I mentioned is equally culpable yet for some reason some people have chosen to scapegoat my design as THE example of copyright infringement-TrivitsMeBoy, Manos, Ava Adore discuss-Personally, I think it's pretty self-evident that if you say my design is than the other exs I pointed out are too, but for whatever reason I'm getting all the criticism.

Manos is right. Here's a little legal lesson: a lot of things that are technically copywright infringement are allowed because no harm is done (i.e. Hendrix shirts are just great advertisement!) or it just wouldn't be worth it to go to court, but if the use of copywrighted image is significantly "harming" (i.e. stealing profits, hurting reputation) a company, then they WILL sue. Threadless probably allowed this T-shirt because 1) it's not being sold for profit (just part of a contest), 2) even if it was, it probably wouldn't sell enough to actually threaten the people who own copyrights to Smurfs (sorry Kamiblue!), and 3) is not so "malicious" or harmful to the image of the Smurfs that they would take any notice.

Richgama-I dont know what makes you think that the Hendrix estate or David Bowie or Mr T or the Christopher Reeves estate would consider someone else profiting off their likeness 'great advertisement'.
I'm not sure what your point is though I agree all the designs I mentioned plus many others are clearly some type of copyright infringement, although many(those w/elements of parody) could also all be argued to be fair use. Threadless apparently does not seem to have a problem with this as you can see by the list of winners(dark side of the garden-operation needed,you sank my battleship, neon monkey(planet of the apes), the fast supper, dad?,neonmedia2, bleeding sun remix,etc) which all fall into that category. I dont have a problem with this either, my qualm is that my design has been singled out and demeaned as some type of aberration by Manos and TrivitsMeBoy while it seems the norm on Threadless. I am not even talking about the vectorized images and copies of previously submitted designs. But what irks me most is that the design now directly next to mine, elliot's new friend, which is clearly the ET poster with minor changes, has received nothing but praise from the Threadless community and here I am defending myself against almost universal accusations of copyright infringement. Personally, I think elliot's new friend is great but if Manos and TrivitsMeBoy feel the necessity to comment on mine where are their comments on it and all the like?
