Did you draw that? It looks a lot like CSA print stock by the Charles S. Anderson company.

The composition is great, typography is really fun. I'll buy it if it's 100% original material!

Alas, I'm not that great at drawing - I vectored it (which took me a looooong time) from a 1960s pamphlet cover that I got at an estate sale and scanned -but it appears to have no copyright nor even an artist's name on it - you can see the scan though if you wish :-)

The typography however is all me!

Btw that CSA stuff looks pretty cool, I'll have to look through it sometime

It depends on when the pamphlet was published whether it's still under copyright. Whether or not it had a mark, it could've been renewed under pre-1978 copyright laws. Post 1978, every unique writing/image/sound recording is automatically copyrighted to it's creator the instant it's recorded and that copyright holds for the author's lifetime + 70 years, minimum. I doubt Threadless would publish something derivative without knowing 100% that the copyright on it has expired.

It's a shame that there is such a lack of understanding of this stuff, especially among young designers, because I hate not being able to get behind pieces that look really great visually. Sometimes I just have to because I can't get behind the ethics.

I understand completely, and now you have my curiousity to see if this is really under copyright or not. I did a google search for the thing, and this is what I found: http://www.venturapacific.net/cgi-bin/index/0029164.html

Drawings are by Dick Shelton.

I don't believe the cover is done by this Dick Shelton, as it's in a completely different style than the inside illustrations. And I did ask a friend of mine who manages artists and he didn't seem to think it was under copyright either, but who knows.

I will say though that Threadless did print that Darth Vader shirt... dunno if they got permission or not though, heh.

Anyways, I am glad you're getting on my case, I really should try to be more careful about copyrights and whatnot. :-)

i like every element of it, but i'm not sure i understand the nachos thing. if i'm walking around with a bunch of (very nicely drawn) words on my chest, i wanna know what they mean. ESPECIALLY if the words are about nachos.

Talierin, thanks for being patient with my fuddy duddy designer stuff.

I think you could probably get away with this, but when you're incorporating someone else's artwork, it's always a gamble. To be 100% legit, you and/or Threadless would have to contact the publisher for licensing permission (assuming they hold the copyright).

The Darth Vader design would be a different issue. If that author copied the drawing from a movie still or promo shot, it's a copyright violation. If they did it from memory, it's more of a Trademark law issue.

It's all touchy subject matter. The reality is, if something isn't 100% yours and/or done with full permissions for the originators, it's always a gamble. If you've ever known anyone who has been sued for copyright violations, you get a lot more careful about how you make art.
