I made a completely new drawing based on the original on but without the boats and with the rig and oil in the water added.

It looks really nice! but maybe it would have been better to vary more the shape of the original wave so it evoques the original painting without looking too similar

I understand what you mean but if I had altered the waves to a more obvious extent this wouldn't have been much harder to do or more time consuming and the allusion to the painting wouldn't be as striking. Plus there have been various designs in the past directly based on other images; I think it's not forbidden as long as your material is in the public domain :)

i love it. i recognized it right away of course, but i think its perfect. i don't think its too similar. the oil rig is obviously not a mountain. 5er.

As I said, I understand your concerns but what's wrong about taking the waves by Hokusai as a base and adding something to make it something new? This design and its message is totally different from the original painting.
Look at those two designs:
Pros and Cons by fatheed

Gentlemen Love Light Swords by alvarejo

Both designs are amazing work and have been printed by threadless and both are based on images with some special addition making them something completely new.
It's nothing forbidden and I never tried to disguise the fact where I took the material from.

I do like this. Although if you did want to take it a little further, you could set the oil rig on fire, and add an oil slick in the water - not only would it look awesome but it would be extremely topical for at least the next six months (that spill is not gonna go away in a hurry).
Thanks for posting your sources and not just copy pasta-ing the original, even when you intend it to reference the original - respect dude.

When I say an oil slick... I meant something much larger (I can see one is already there, but it's not immediately obvious)

I guess it could be the problem that many people don't see the oil slicks at first glance but there are several and they are of course an important part of the design.

Nice wave. If you redo this you should add some angry dolphins! :) The slick really reeks when the wind currents blows the oil smell this way.
