Fierce.

What is she holding, though? You should make that more clear.

You have some great stuff on flickr. You should sub those designs instead!

supertrooper74 on Sep 29 '08
All you have to do is a google image search for Grace Jones and it's one of the first images that shows up. All you did was put a filer on it and add some shapes behind it.

bad karma coming your way. + you're 33 years old, you should understand copyright rules and being respectful of other artists' intellectual property. 0

WHY is the microphone plugged into the wall, or nothing?

damiankingart.com on Sep 29 '08
the copyright? Its so far from the original it doesnt need a copyright! If you dont like it dont vote for it! Im not trying to infringe on anyones art. Its a reference being made to the album cover, bringing it into the present. Haters! Ginette you can stick it! I got no bad karma coming my way!

ginetteginette
   ginetteginette on Sep 29 '08
haha. STICK IT. filtering the shit out of something doesn't make the image yours. what do you mean it doesn't NEED a copyright? that doesn't even make any fucking SENSE.

you are not referencing, you are copying.

you really aught to stick to the stuff you've got on your flickr, it's pretty great actually, while this photoshopped shit really sucks.

okay because i'm looking at the original right now and i'm not understanding how changing the color of the band around her knee and breasts make it so far from the original that it doesn't need copyright...

looks like all the other copyright infringers out there trying to steal artwork. Try something new. stealing work is old... boring...... bad karma for stealing images that don't belong to you! you must have gone to DeVry Institute. It shows.

have you never seen art that contains a piece from something else? Think andy wharhols Marylin, copied from an original photo. And recopied many times since. I understand your beef (everyone), but I believe it is far enough removed from the original that it is in the clear. I wanted people to recognize the image, thats the point. I didnt want to "add" a bunch of stuff to make it look ''different". I bet if I looked at yer work I could find things that you have taken from somewhere else! Why are you all so sore? If you dont like it, pass... Yer not telling me anything I dont already know.
ppatrickkylee
ppatrickkylee on Sep 29 '08
We're sore because we're artists like the author of this photo and we'd be pissed off if someone was attempting to make money using a photo that we took.
ginetteginette
   ginetteginette on Sep 29 '08
taking inspiration from something is different then taking a pre-existing photograph, cutting it out from its context and then photoshopping into half-oblivion (i say half because you've hardly done anything to the model at all to making her 'far from the original')

you are not andy 'wharhol', nor are you andy warhol.

ppatrickkylee.... look at my flickr stuff before you accuse me of being just another copyright infringer! So lame! Never seen so many haters! Why y'all so mad? Dont think threadless would allow it if it was infringing. In fact they turned down one of my other designs that WAS infringing for using an existing logo...

Didnt say I was or ever will be Warhol.. Just saying that it has been done before people. get yer panties out of yer crack and move on!

I enjoy the over abundance of exclamation points used in this argument. It is serious business.
damiankingart.com
damiankingart.com on Sep 29 '08
Just because they turned down a design doesnt mean i'm an infringer! It means I used a logo that has been used before. How does that contradict me telling y'all to look at my work before you catagorize me!
ginetteginette
   ginetteginette on Sep 29 '08
please just take this for what it is. this tshirt design is bad, your illustration work is good = submit some of your personal illustration work. this grace jones knock off will not be printed i assure you.

   C Kid on Sep 29 '08
Comments are important! Your paintings - The Sleeping Pill Sheeps and The Crows Money Nest are great. Turn them into T-shirt designs and sub them, and you will see that people here can give nice comments too!
Torakamikaze
   Torakamikaze on Sep 29 '08
you do realize that the people saying this is a bad design are also saying that your work on flickr is good? i mean... cause it is. so, though it may come off as 'harassment' to you, Id say people are being quite encouraging... in a bluntly honest kind of way.

So rather than get all overly defensive, and proclaiming that no one should be allowed to comment on this, you just accept the fact that this is not one of your stronger pieces and move on. You've clearly got the talent... it's not worth it to huff and puff over one design. The worst thing a designer can do is go off on the people that dont like theyre work.

Want to leave em speechless? Do it with your art.
damiankingart.com
damiankingart.com on Sep 29 '08
Torakamikaze you are totally right. I shouldnt have been so damn defensive. I have never been accused of stealing art or copying! That is very offensive to me. So pleez excuse my attitude. I think people can leave their opinion without getting personal, or accusing people of things when you have only seen one piece by them.
Torakamikaze
   Torakamikaze on Sep 30 '08
Its understandable to be offended... but it's also understandable why you'd be accused. It's just too similar to the photograph. The thing is, round these parts voters come across a lot of theft, so theyre quick to make the call on things.

Like I said, it's just better to move on and learn from mistakes (though you may not necessarily view it as a mistake from a personal standpoint). You have to keep in mind that your putting your work out there for a huge audience to vote and give their opinion on. Even if it's personal to you, you have to kind of detach yourself from it, otherwise every time you let a negative comment affect you, you're just gonna bring yourself down. So just go with the flow, and use it to your advantage to keep improving.

Best of luck! Keep on subbing

Quite interesting conversations here.

Hey, damiankingart, if they were really harrasing you, just turn away from it, because as you can see, explain doesn't help. The most important that, you know you didn't do it. Ignore all the untrue, cuz the truth always win.

Learn from their arts, and make your own arts;

Conquer their hearts, and make yourself proud in your heart.

Let's keep moving on! Until there's a shield beside of our name. This is just a minor obstruct of your goal. We still have a lot of job to do, right? Stay cool, Stay focus, Peace out.

By the way, the black girl of your tee can make a good design - if make her looks not so distort, and off the blue and white stripes there, and get some repairing and it will turn out great. Of course, this is just my little opinion, jajaja.

Oh ya, sorry for the bad languages. ^^

demiankingart - you might want to consider this

http://www.threadless.com/abouttagged

although you ran it into more filters, in the "tagged" case there has been effort too - it's not *the* original design, the design has gone through some processing.

But then again, there's this, that did go through

http://www.threadless.com/product/794/Le_Voyage_Dans_La_Lune

which is a "copy" of this (with one detail's difference)

http://www.moma.org/images/collection/FullSizes/Melies_TripMoon_largest.jpg

But in this case the original artist died just 70 years ago. Isn't that when something becomes public domain in the US?
ailaG
ailaG on Sep 30 '08
And another thing, I wouldn't reply here more than once or twice if I were you, since this convo isn't going anywhere.

Do most people even come back to see the replies to their comments? They usually comment and then continue voting and forget all about it..

It's better than wasting energy into this argument. If this photo gets a high vote, tell Threadless about the photo it's taken from, and they'll check with their lawyers. We're not lawyers so there's no point arguing about infringements. It's good that someone brought it up, but the rest of the argument is just useless.

I saw the 'making of' of the original photograph once. It's one of the best art directed artworks I've seen. It's all cut and paste and airbrushed again. Grace couldn't even hold that kind of position, so they faked it -- very surreal.
