I don't think a heart-shaped hole in the chest is enough to say it's derivative. that concept doesn't seem that unique to me that people couldn't have thought of it independently. Also, the style of illustration is completely different. I think it's a bit emo, but cute. My daughter might wear it, but not I.

I'd like it better without the 'Grim Reaper' elements (the cloak and the scythe) on the right-hand figure. With them, it comes off as very Emo. Without them, it could come off as merely anti-cutesy.
