his pose sort of reminds me of that famous blurry bigfoot photo...except he's surrounded by graffiti and cement rather than the forest. and oh yeah, he's smiling...which is probably indicative of him being happy that he's on the shirt that's gonna win the kickin' it old skool contest.

Yeah, I think Ghettoblaster Shoulder along with Half Blindness From Bangs was a recognized medical disorder in the eighties.

I'm not crazy about designs that occupy a rectangle or square on the chest. It's an uninteresting shape, and part of good tee design is occupying the space of the t-shirt with interesting shapes and negative space, IMO, since they're often seen at a distance, or a glance. If the wall was cut away from "Break" it would be much better.

A big chunk of printed area also make for a thick, plasticky sheet that doesn't sit well on a girl's curves.

break is a photo...somewhere in NY i think...

yeticorn ia a responsible b-boy and likes his eardrums undamage...besides this is a candid moment, and not a stance.

maija: live a little;) it would get your boobs attention. and that COULD be a good thing (if you want that kinda attention)...

maija
maija on Mar 22 '07
A big plastic plate across the chest isn't attractive. It is unflattering to the boobs, making them look misshapened.

If it's not even your photo, are you angling for another Tagged saga? ;)

so it's ok to take a photo of someone elses artwork? altering it is fine...please let it go. hell look at that select shirt Anacaona...you bet he doesn't OWN that photo that he used.

so please. why you gotta try and bring me down?
grypesagon
grypesagon on Mar 22 '07
No dude what she's saying is that if you don't live in a place with graffiti and never learned how to make it then you should never ever in your life make a design that incorporates graffiti. Because using a photo that someone else took in a place that has graffiti is unprofessional. I mean look at her anime user pic. I'm sure she's either from japan and took that image herself or drew it personally. Otherwise why would she ever use it as her representative icon.
tiphaine
   tiphaine on Mar 22 '07
that's definitely not what maija was saying and i think she asked a valid question. if it's a photo you took yourself (or secured the rights to) of an anonymous tag, then everything's fine.

as for anacaona, if that's a stock photo i feel confident that threadless licensed it for printing.
mezo
   mezo on Mar 22 '07
You are overly defensive about a simple question. You could have simply said "yes, i am ok with taking someone else's artwork". It's cool, man!
maija
maija on Mar 22 '07
I'm not trying to bring you down, I'm trying to help you improve, actually. I dig your work.

My avatar is by Japanese artist Takehito Harada. A friend of mine was reviewing Harada's portfolio for character design for an animated show and saw this image and thought it not only looked like me but captured my cute yet evil nature, as well as love of picnicking outdoors. Using it as my avatar certainly violates international copyright in the strictest sense, but I could probably claim "fair use" since I'm not making any money off of it.

The Ana Caona image may be in the public domain if it's from the fifties.

The grafitti in my town is lame.

   r.o.b.o.t.i.c.octopus on Mar 22 '07
anyway, graffiti itself be it BANKSY or CHAKA is considered illegal...so it's not a matter of making a stencil for an art show and stealing a photo of said stencil for an art show...it's a photo i found (emailed the photographer about it anyway) of a wall...

had i used another photo of a BLANK wall and photoshopped my own "break" over that...i'd hardly think you guys would care. "is that YOUR photo of the BLANK WALL!?" but maybe you would care...

so i think threadless should be the ones (if this was to win) to pull me to the side and have me straighten out any legalities that need to be straightened.

also...WATER BASED INKS don't feel like plastic. and Threadless uses them.
tiphaine
   tiphaine on Mar 22 '07
When you get the email about winning, there's some stuff in there about your source imagery. I don't think they'd be any less thorough with Select artists. Maybe, but I don't think Threadless would be that careless about legal liability.
tiphaine
   tiphaine on Mar 22 '07
Regardless of ink type, Threadless doesn't do discharge printing on non Select shirts, so maija is correct. Large print areas mean no stretch over the boobies.
mezo
   mezo on Mar 22 '07
I am not trying to be all up in your butt about this...but I do have friends who are avid graffiti artists and I know they would be perplexed to suddenly see someone walk down the street wearing one of their art pieces.

Going further, they would be HIGHLY pissed to later find out that the shirt was sold to the wearer, with the original artist not recieving as profit. It's as disrespectful as someone tagging over someone else's piece.

Make sense?

The whole bit isn't about keeping you honest, it's about saving you from legal frustration and an embarassing pile-on in the blogs and beyond. It has happened to a couple of other artists on threadless because they didn't know they were treading on copyright toes when they used someone else's material.

Good for you for contacting Break. That's a professional move. Getting your design printed by Threadless is professional work-for-hire, it should be treated as such.

i am going to stay out of the whole drame issue, and just add my bit of constructive crit:

i enjoy the contrast in styles, but i think that the background could be blended into the shirt better, i like the top and bottom how they are, it would just be nice if the 2 sides faded into the shirt...this would further express the motion of waliking.

helo
helo on Mar 23 '07
interesting thought J-Ray

You're probably right about the artwork being vandalism,
but we don't absolutely know that. Will knowing change
my score? I've never had to think through a situation like
this before so I'm still undecided.

*just finished thinking about it*
If it's vandalism, then whatever BREAKS says doesn't
matter and r.o.b.o.t.i.c.octopus is scott free unless the owners of the property that was vandalized become the
owners of the artwork and they end up frowning upon
r.o.b.o.t.i.c.octopus's use of the artwork.

So if the artwork's legal owner (whoever it is) doesn't
decide to allow r.o.b.o.t.i.c.octopus to use it, then
I score 0, otherwise the score is higher.
fatheed
   fatheed on Mar 23 '07
I can't believe some people have made such a big deal out of graffitti. The people that created the original 'tagged' image are commercial artists - this is a most likely a piece of illegal vandalism. And if it is, how could the originating artist (a) prove they did it and (b) make any legal case concerning something that is illegal.

Also - how far does a source image have to be re-interpreted/reworked before it is no longer the work of the original artist? Would the estate of Edvard Munch consider suing threadless over the Scr-EMO t-shirt? I doubt it, as they don't know about Threadless.

I rest my case M'Lord.

that's awesome! i know you think we were acting like a pack of wild dogs tearing at you, so i appreciate you following up on this anyhow. i still think a little more fading out in the corners would do this a world of good, but this is a solid 4 from me and that change would make it a 5. the depth of this works for me in a way that your other yeticorn subs haven't quite managed to.

   r.o.b.o.t.i.c.octopus on Mar 23 '07
i think this is the closest to a collab we'll come, the dude's nice, just got offa the phone with him...he said that peice wasn't even finished and it's on a public walla nd has no copyright, he's also happy (really happy) to see his work like this...he likes the design. and he said if he needs too he'll step up and TCB! (sign papers etc, although legally there's nothing he needs to do like that)...he also added me as a pal to his myspace! woo!

haha.

tiph i dunno about the fading in the corners as i did the white in the back with a "paint roller" all sloppy like...almost how it'd be done with a stencil (just reversed).

so 4 or 5 or 3 or 1 put a $ up there! just for fun! word!

People who are scoring 0 because they think they are the arbitrator of copyright law need to get their head examined. It's up to Threadless to decide that, and clearly RoboPus has permission. Just vote on the design. Threadess wouldn't print it anyway if there's a real problem, which there isn't, as you can see from his correspondence with the original artist.

   r.o.b.o.t.i.c.octopus on Mar 23 '07
well teh aqua will cancel out the yeticorn colour since they are so similar, this one only works on darker colours so that blue is the closest you have...sorry. no aqua.

although jkeezy is wearing the blue, i'd say red for dudes and blue for the ladies..

Y'know, before I saw the commentary I was going to say that I didn't think it needed the grafitti in the background, just the yeticorn strutting his stuff was great by me. Then I saw the comment that the boombox needed to be on the shoulder, and thought, "that's a great idea!"...but then noticed that it would likely take away from the reference to the bigfoot footage. Right, good point there. Then there was the copyright argument, which got old in a hurry, but ended well enough. And as for the large image across the chest, well, maybe it would bother me if I had a bigger set. But I don't, so it's dandy by me. I hope, for all you've gone through on this, and for the sake of yeticorns everywhere, that this gets printed. Great work. $5
