about Who I Am
I was wondering around Myspace (pathetic I know) and noticed a girl had this design as her profile background.

I've also seen Motovino as a myspace layout.

as long as they arent selling it, i see no harm being done.

I use Rock-how-to as my background...
UberRyan
UberRyan on May 26 '06 at 8:02pm
theres no problem with that. I know tons of people who use FITA, with different color variations, Motovino, Who Am I, Grab Ahold of Life, Pandamonium.

No harm no foul if they aren't selling it or saying its their's

before I found threadless, I had more than one threadless inpired layout.

I find it quite hilarious.

Aaah that's alright then. I just thought it might have been copyright infringement or something.

It is a copyright infringement to use an artits's work - even if not commercially - without permission. I've been alerted to my Lulu design being used as a blog layout, PSP tube & on an avatar site, & I've not taken kindly to it. The fact that people mess with & modify my work & redistribute it without my permission, & without fully crediting me, really makes me mad.

Copying (which amounts to theft) is not a compliment.

I urge people to use my images as profile backgrounds.

It's very flattering when someone likes your design so much taht they want to see it every time they log into myspace.

If people were profitting off the design by printing them on tee's/bags/posters etc, then that would be a different story.

Do you mean profile BGs on Threadless? If you've given permission & the work is recognisably yours (so there are no misconceptions re. who made it, & it all traces back to you) then that's all well & good...but as you know, when you're a working illustrator/designer, exposure is all-important...to see your hard work plastered all over the internet without a single credit or link tracing it back to you, is frustrating. If people like your work that much, then they should do you the courtesy of asking permission & crediting you.

Yeah, I would want people to use my design as a background. Infact, my best design of all time "I <3 Nanas" is now in wallpaper form at http://www.threadless.com/profile/267478/jpiatt/47811/By_Popular_Demand...

2 sizes!

I mean....when my fans ask for something...I deliver!

I'm not being precious about my work here...I've been doing monthly calendar wallpapers for years...the difference is, that's with my permission & my blessing that I offer those for people to use...just like with your nana WP.

Giving something away & having it stolen from you are 2 very different things.

No that's true kareena, I agree with you on that.

Unfortunately no one's interested in stealing my work. It seems every other threadless tee has been faked except mine :/

Sometimes it makes you feel paranoid.

Hmm...a fake Threadless tee...now that WOULD be a claim to fame! Considering mine's selling slower than a wet week, I can't see that happening in a hurry...

Do the counterfeit tees still have the artist's credit printed on them I wonder?

eskimo, I would fake your Jesus Was a Streaker tee if I knew how! Does that make you feel any better? :)

i've got that t-shirt as my computer background...mainly because it was completely sold out and i loved it too much. of course, now that it's reprinted, i guess i could buy.

anyway, who's claiming it as their own? i've seen several myspace profiles featuring various threadless tees as the background, but none of them say, "yeah, i drew that."

because really, does anyone tag their background with the true artist? i think not.

I work on a site that displays art, I've seen a few threadless designs make their way through and dissaproved them.

Anyways, I saw this particular design on a store sign in the window the other day. @_@;

it does get annoying if they direct link your images, though, so it takes up your bandwidth.

Isn't basing an illustration off a copyrighted photograph without permission the same as plagiarism? It doesn't matter whether you "acknowledge" that you did it, as long as you didn't get permission -- which I doubt the artist did unless he speaks Japanese. And this is pretty much a direct copy here, not just a reference. Personally, I'm not going to make a big fuss about it because I'm a big filthy communist but I hope Guilherme Marconi doesn't decide to come down too hard on anyone who uses that picture for stuff like myspace page layouts (especially since, unlike him, they're not making any money off of their efforts).
LOBSTRA
LOBSTRA on Jun 28 '06 at 3:53pm
Ahahaha in retrospect that last post sounds like a veiled threat. I just meant I'm not going to complain about it too much, but I hope the artist doesn't complain about people using his work because it would be hypocritical. From the looks of things, it's other artists who seem the most pissed off about it, though.

Sonmi is right about the bandwidth thing, but that's more an etiquette issue than anything else.

Question: What do you guys consider immoral plagerism vs what you'd consider acceptable reference and usage.

Such as my latest submission, which I full acknowlege when I got the base image from:

And does it make a difference if design is really a side part of your life and not one where you make any money at?
