But I think someone does have a ligitimate argument that the tree from the design is straight out of a textbook....which is kinda a copywright issue.

there are plenty of copyright free images though. See for example, many Clip Art books.

I wouldn't have expected that design to score highly even if it wasn't a borrowed concept made with stolen art. I can understand how some people would like it, but I was quite astonished when I found out that was the highest-scoring design ever.

I agree that a lot of the old designs wouldn't score nearly as well by today's Threadless standards. Threadless inflation....or maybe deflation....I'm confused.

clipart is not 100% bad if it is used in the right context.

With Predicament, yes I believe the concept was pretty much plagiarized and that is wrong. However ASIDE from that, the way they used the tree clipart doesn't look bad IMHO. He could just as easily have taken a photograph of a tree, live-traced it and it would have had almost the EXACT SAME effect as the clipart image.

If the clipart he used was copyright-free and available for public use, it's just a different means to get the exact same effect.

I don't think the argument is that it looks bad, I think the argument is that its lazy and lacks artistic talent to take an image created by someone else and use it in your own design.

Me personally, I wouldn't want something done by someone else in any of my designs unless it is a pattern of some sort and it has been made unrecognizable (like argyle or something).

he pretty much went into it purposely trying to translate a famous painting onto a tshirt. it's all really lame and a really bad design. i cringe every time i see it.

oh yeah, i forgot that another part of the controversy was that the tree used is like the first google result you get if you search "tree silhouette", or something like that. there were a ton of trees exactly like that that were showing up in subs back then.
