this is... the same exact concept as a shirt I have from Delia's, although I must admit like the typography on this a lot better.

Yeah, my friend owns a version of this shirt too, only it's blue with yet another different text. This is the first time I've seen Threadless print a shirt with a basically blatant reworking of an already popular tee.

Been kind of a bad week for new Threadless shirts in terms of unique designs. Two of the other designs have basically been done at shirt.woot:

http://img109.imageshack.us/i/f5refreshesyouj3istanda.png/

http://img132.imageshack.us/img132/5639/thumbwar2dcstandard.jpg

Although the love one getting printed before by the same artist is a whole other can of worms I guess.

stalliongsta
stalliongsta on Nov 10 '09 at 8:24am
the illustrations on the threadless designs are way better than on those woot shirts. and the f5 concept is similar but different. i'm not too concerned about those.
WellingtonIII
WellingtonIII on Nov 10 '09 at 12:26pm
Because you think the illustrations are better that somehow makes it ok? Really? I thought Threadless was known for having original designs. I seriously doubt they would have printed any of these designs if they would have known about the originals. I don't think they want overhauled designs that have printed elsewhere. Correct me if I'm wrong here.
Maltzmania
Maltzmania on Nov 10 '09 at 12:29pm
those two concepts you speak of Wellington are pretty common, and the designs done are different variations on that same concept, if you think the people who designed "Thumb War" with two thumbs fighting, or "F5 being refreshing" were completely spawned by woot shirts, you're a bit off base. These are not copies. These are not misappropriations. They are basic design concepts, done in different styles and with different aims. Unless there is concrete proof of stolen or copied material it's best to move on.
WellingtonIII
WellingtonIII on Nov 10 '09 at 1:13pm
When the F5 shirt at woot went up last year there were no similar shirts out there. People checked. There may be some on zazzle or cafepress now, but that just furthers the argument that Threadless probably shouldn't have printed it if they wanted an original phrase. A simple search on google would reveal that it exists. The fact that you are defending it as a common phrase or idea makes me wonder why you would even submit it as your own slogan to begin with. As for the thumb war one, again, copy or not, it looks like Threadless is doing redone designs from another site (even on the same shirt color no less). Obviously they don't want that. Personally I don't want that, I come here for the (usually) very original and well done stuff.
Maltzmania
Maltzmania on Nov 10 '09 at 1:19pm
while that may be true, i'm saying it's the IDEA, not just that it's on a t-shirt. The idea of oh hey, "thumb wars" christ there was even a movie called Thumb Wars, it was pretty good, and that came out way before the woot shirt, and that was based off star wars which came way before thumb wars, and star wars is based off of an old hero archetype...et cetera...

it's the idea that's basic. Because woot had someone submit it first does not mean they lay claim to that as their own original idea. As for the slogan, I'm saying, making the connection between F5 and being refreshed...is...extremely simple and common, the wit and organization of the words to create an effective slogan is different.

I could type more but i can't be arsed, I respect your right to defend woot, and those designs, but I think you're off base.

WellingtonIII
WellingtonIII on Nov 10 '09 at 1:46pm
I'm clearly not off base. Go to woot, go to zazzle, go to cafepress. This shirt existed well before you put it out there as a slogan. Whether or not you came up with it independently isn't the issue so much as it's been done! Frankly the fact that it's on cafepress is more damning in my eyes than it being on woot as something Threadless probably shouldn't have run. Someone (including yourself) should have checked on it before it made it this far. Google, people. If someone had looked up thumb war shirts before they designed it they might not have made a shirt that looks so much like a shirt run at a competing site. But what do I know, I'm a prude, a jerk, etc. We don't like to talk about those kind of things here so I'll leave it at that.
Maltzmania
Maltzmania on Nov 10 '09 at 1:49pm
What. I didn't make the slogan. Superryan did.

So, please, check your facts before you make allegations.

I never said you were a jerk, prude, etc, I respect your opinion!

Just realize that, what I'm saying is the concept, idea, BEFORE any of these shirts was there...

Yeah I was pretty shocked to see this on the front page because I've seen it before at a store here could Supre, which is generally a source of lame slogan tees about Twilight. I wouldn't be surprised if they ripped off the Delia's version though as I remember the typo being pretty crappy like that, although it was on a white shirt. But we have pretty convincing evidence that this one came first since it's been up at lafraise and it's much better done, so good on you.

from the threadless terms & conditions:

doesn't being printed at lafraise count as being "previously published"? or am i misreading this?

before everyone starts blaming threadless, i think its important to realize that they aren't infallible and shit like this is bound to happen from time to time.

i dont think this shirt should have been printed because it was printed somewhere else first (previously published) but i'm sure that it just slipped under the radar.

a way to avoid this though, is for the artist to read the agreement and not submit something that was already printed...

in order to submit a design, you need to check a box stating that you've read the terms & conditions. of course, not everyone who checks the box has actually read them...

Dan actually hacked into my account and subbed that F5 slogan.

AdderXYU

i love how the first thing people do when seeing something done first is say "Well, I like this one better, so..."

I was pretty baffled why this original tee got printed to start with, simply because it seemed incredibly weak by threadless standards. If it was printed elsewhere prior, and has had renditions printed by others, I'm simply hoping Threadless does the right thing, for the fairness of everyone else who plays by the rules.

As for the woot similarities, you simply cannot play off as if it doesn't matter. I think Thumb War can be argued, but I really don't think the F5 slogan can still be considered original. It's hard to copyright a slogan (which explains the vast popularity of sites like Snorg), but for someone to get $500 just for saying something on a site with as many slogans as Threadless, it should really be confidently unique. There are SCADS of slogans on this site that have never been printed on a shirt.

I have no clue if anyone involved knew of the two woot tees or not, but that reeeeeally doesn't matter. If the tee existed already, it existed already. No amount of defending friends or peers or the threadless community at large is going to change the fact that three of this weeks shirts simply are not remotely original.

SuperRyan - I see absolutely nothing wrong with your slogan. Zero. Ziltch. There are going to be similar things out there as people said, you slogan was masterfully worded and deserved the artistic merits of Andyg.
