If you actually wanted to make a stand about not wearing a brand, why buy this shirt, thus making yourself a hypocrite. If you stand by the declaration, then you would make this shirt on your own instead of buying a printed copy that a brand and company made.

Not to mention you would be presenting someone elses idea, which ruins the im so freaking original statement the shirt tries to make

This doesn't make you a hypocrite at all. Wearing a specific t-shirt and wearing a branded t-shirt are two completely different things. The point of this is that a black spot doesn't represent anything. There's no branding or advertising in it at all. Now, if the shirt gave that rant and then said "Threadless." at the bottom, you would certainly have a valid point. But the "oath" on the back does not apply at all to this shirt, or even most shirts on threadless.

The oath isn't about refusing to be a part of companies/corporations; that's inevitable. It's simply to avoid being a convenient form of communication for them. And most of threadless transcends that.
