I am not sure about graffiti being protected in copyright law, most likely it is. If that is not copyright infringement, then stealing the person's photograph from the internet is.

shirtflirt and Phil404, just so you know, the original was not straight onto a wall, its on canvas. So yes it technically can be claimed as it just like any other piece of art that someone spent hours working on.

Do you think we would of printed this if we knew it was a rip. Give us a little more credit than that.

RocketRobyn you have disgraced alot of people and made threadless look bad. Not to mention you now look like a thief. And that you ripped it from a photo of a stencil is even more lazy and pathetic.

Usually this kind of rip is caught in the blogs, and when it is we pull it from the site immediately.

We are now trying to figure out the next step...

yeah carmen i have the same feelings. i was actually thinking of buying the jacket and the shirt. but now i just cant seem to do it.... but i dont want threadless to have wasted all that money, i know they had no idea it was a rip

i feel sorry for threadless, wasting quite alot of money to get these printed.

the only "way" to fix this in my opinion is to contact the original owners of this design and get their approval to continue selling it. maybe give them a little commission or somthing.

of course its copyrighted, they still have the original stencil! i know i would keep that. its like photography, people do not have the right to reproduce your pictures without your permission, but in the digital age its hard to keep track of because some images are up for grabs while others are not!
its so stupid. i notice the horizon line wasnt straight. but after reading this and realizing she jacked the design from a angled photo of the stencil, it would explain how everything is tilted and warped. a smarter person would cover their tracks by cleaning up the image and fixing the perspective. HOW AWFUL IS THIS situation. threadless i still love you, but people like this should be ASHAMED and shunned

the next logical and ethical step is to disable the purchasing of this item. nothin' to it. but it's still active and Threadless is still making money by selling these shirts/jackets...especially by the stock chart it seems you've sold quite a few.

i tell you, you aren't printing any of my subs, i know it as they score way too low to get noticed. but on the off chance that someone rips off a design i've done, as blatantly as this...i would definitely seek reparations from threadless and the offending subber.

do a background check with the subbers available websites etc. you shoulda printed OCTOPOSSE.

i wouldnt be surprised if the stencil was indeed destroyed by the artist. this is a common practice for printmakers. it helps prevent undesired reproduction of the piece...

As THREADLESS grows, they are earning enough money so they can research if designs are original or not. This is something all companies do, and one that accepts submissions from the public REALLY needs to do.

The fact that they have not immediately taken the shirt off the site only shows their lack of commitment to dealing with this issue.

gimetzco, it would be too much for threadless to do background checks, as designers here have their own sites and submit to other sites that also prints shirts and so on and so on. (octoposse was nice but i think the lines need to be cleaner) threadless is stuck between a rock and a hard place, so i understand why they didnt take it off so soon, what are you going to do with so many shirts/jackets? i mean besides making the submitter try to pay for it like others have suggested

stubbythumbs, ive kept my oringinal stencils, but then again im a huge packrat.

but considering what you said, it reminds me how photographers print limited amounts and edition of their photographs, never to be sold again. but to know that the oringinal was for a festival/contest, im sure the stencil was kept for some time to show/exhibit in other places.

im ranting about this, because if someone jacked one of my photographs without giving due credit i would be mad, though its raising awareness about whatever is stolen. i bet a bunch of people are now in knowledge of the stencil/street art community that wasnt aware of it before.

Give them a break...sheesh. If there is anyone you should be ridiculing, it's the artist for stealing the work. That's the whole point and since the company didn't have any knowledge UNTIL it was printed, how can you blame them? This shit has happened before and I think everyone just needs to let them deal with it.

It's a shame that it happened. Just let it take it's course. It's not like they are shipping the attire overnight (unless it already happened to some who have ordered it). So it'll most likely be taken off and people will be refunded.

I agree. I do not think this is really Threadless' fault. The fault lies with the artist. I've never seen the original before not being a fan of graffitti art.

I can sympathize with the original artist for being ripped off. "Stealing" is wrong. But I will say I've lost alot of respect for ghostpatrol (and other certain individuals) for jumping to conclusions and not handling their complaint in a mature and professional manner. Instead their first instinct is to jump on some obscure blogs and bitch and whine giving threadless a bad name and making it sound to anyone reading it that threadless knowingly and purposefully printed something that was ripped off.

This isn't the fault of Threadless.... they can't go around and check every single image. They're in the business of printing the high scoring designs. It's us, the community, who picks which designs we like best... we should be blaming ourselves for not catching it. If 2000+ people didn't see it while scoring it, do you think that just a couple dozen people printing the design will catch it?

If you read the last comment on that second page you linked, you would also see that Threadless is not going to pay the person who stole the image and is going to resolve the whole issue as best they can.

To clarify -- we are not blaming Threadless. They didn't take the design knowing that it was stolen [if they had done so witch such knowledge, we would be approaching this very differently].
This is the fault of the "designer", and hopefully this will sort itself out in the next few days. [Who, by the way, has claimed to have done these designs -- "This is a t-shirt I designed for Threadless."]

As yet, either GP nor I have yet been contacted by either the company or "designer" to fix this, but Jake from Threadless has left a very nice comment for us on "You Thought We Wouldn't Notice".

Although Threadless are aware of the situation, they have not yet pulled the design from sale."

Yeah, it's obviously not Threadless that's to blame.
Infact, when you win, it says to let them know about any photos or stock images you reference. So, if the person who "won" with this stolen design didn't let Threadless know about it, then how can you blame Threadless?

I can't believe people still do this shit. Threadless is only like the biggest tshirt site on the internet. Do people really think they're going to get by with it?
