It's not threadless' fault, it is the submitters' in my opinion. This has happened before and Threadless is a very trusting community, which is a double-edged sword: we have some great people here but we also have people who take advantage of it.

It's crap that it was stolen, but you can't blame Threadless. Anyway, technicaly I don't think a street graffiti can be owned as such, escpecialy as it's illegal to start with.

But i just wouldn't feel good about just rippin off a design like that. 99% of ideas have been done before in some way, but to copy like this is just pathetic.

It's happened before. I don't know if they do much behind the scenes besides apologize, but they always retire the shirt. It's really not their fault -- yes, they could spend ages making sure everything is 100% in the clear, but in the end, it's the responsiblity of the submitter to do the right thing.

what does threadless usually do in this situation? will they cancel my order? I kinda don't like the fact that's it was copied, but I dunno, I think I'd keep it if they gave it to me.

if you spray a design on a someone else's peoperty, which I presume the original was judging by the photograph in the link, then it's graffiti which is illegal and you can't copyright it.

On one hand, I'll be one of the few with a soon-to-be-retired jacket, on the other hand, it was stolen...

no one was given permission to use this design. it was used without the artist's knowledge or consent. refer to a thread started about this on a stencil graffiti blog where the REAL artists of this RIP OFF are frequest visitors:

i am also disappointed with threadless. i dont understand how they could let this one slip by without checking its authenticity. hopefully they will pull this shirt before the first batch is shipped.

They might not pull it till it's sold out...in the case of def leppard, they pulled it immediately not because of copyright issues, but because def leppard didn't like it and asked them to take it down. But when they finally got real proof that Predicament was stolen, it was right after they'd had it reprinted but before they put it up for sale. In that case, they sold the latest batch, then permanently retired it.

Apparently it was for a legal stencil competition and wasn't illegally painted on the wall in the picture.

It looks like the 'designer" took the original photo of the artwork and just manipulated it because the smudges of the wall are exactly the same as the the smudges on the tee/jacket.

I am not sure about graffiti being protected in copyright law, most likely it is. If that is not copyright infringement, then stealing the person's photograph from the internet is.
