That's a tough one... there are birds coming out of them too.

If it were my own art (as it is yours) I would have issues with it.

the idea might be similar but the execution is different enough I think

At the moment I would say coincidence
FRICKINAWESOME

Maybe inspired, possibly coincidental, but I don't think it's a rip. Really cool tho i must admit, and i already own your masterpiece!

this is weird to me, especially from such an well known/old band

I'm not sure what to think. The idea is eerily similar but at least it's a little different. It's hard to definitely call it a rip.

Honestly, if someone took one of my exact ideas, but then executed it differently, I'd be pissed. Though it sound a little weird if you emailed them out of the blue, asking if they ripped you off.

So if you want ME to email them and call 'em on it, I'll gladly do so :-P

you know, if it were just guys smashing colorful tv's, I'd say coincidence, but birds flying out as well? Fishy.

I'd be pissed if I were you mathiole. :( The concept is exactly the same, although the execution is drastically different.... I dunno, it's definitely fishy. You should definitely contact them.... and ask them to hire you. And fire that guy. :X

totally ripped your ideas.
ladykat
ladykat on Sep 01 '09 at 11:07pm
Maybe they were inspired, but there are lots of differences. Their image has people with bats smashing the TV (that's a really common image/idea, actually)... the birds are really the biggest similarity. Well, that, and the gradient.

I think it looks extra similar because of what you're expecting to see, but if I hadn't seen yours first, I'd see the people as thugs, not executioners.
ladykat
ladykat on Sep 01 '09 at 11:08pm
I think the executioner in yours is what makes it so provocative and original.

The resemblance is a bit uncanny.

You might wanna contact whoever made The Strangers too.

But in all seriousness, I'm on the reserved, but sliding towards a rip.

olie!
   olie! on Sep 01 '09 at 11:21pm
Do you think people can have property over an idea?

I'm just asking because that really seems to be what this is about. Most of us agree the execution is very different, but the conflict rises from the similarity of the concept. Since you can't really prove that he stole your idea, what good would contacting him do?
valorandvellum
   valorandvellum on Sep 01 '09 at 11:23pm
It wouldn't do that much good at all, but I still want to make the "designer" squirm a little bit.
valorandvellum
   valorandvellum on Sep 01 '09 at 11:37pm
There's absolutely no way of contacting them through their site unless you post something in the forum (I didn't want to sign up for an account!). So I ended up sending them a message via myspace. No idea if they'll actually read this or not, but it was worth a shot...

Hello,

I'm writing in regards to your new album artwork. It appears that the idea may have been ripped off from someone else's design (Matheus Lopes). You can check out the illustration here: http://www.threadless.com/product/1604/E_x_ecutioner

As you can see, it's already been for sale and sold out for a while now so it would be very easy for someone to get a little too "inspired" by it. Granted, the execution of the two pieces are different but the concept is exactly the same.

Obviously nobody is going to sue you. I don't think anyone's going to ask you to stop selling the albums. It's not legally in the wrong; however it's amoral and unprofessional of your hired illustrator to straight up steal another artist's idea. If you or your manager could please let them know that art thievery is not acceptable, it would be greatly appreciated!

Thank you for taking the time to read this.

Olie, i don't think we can have property over an idea...but its amoral to 'steal' a very elaborated concept and make it with a different style

ginetteginette
   ginetteginette on Sep 02 '09 at 8:36am
it's shady but this is the kind of ripping you can't do a single thing about sadly :(

(apart from what priscilla did, very nicely)

playing devil's advocate: it could be that this illustrator has never even seen your printed shirt and has just taken something that has become popular as of late (something turning into something/birds) which is not only mathiole's anymore :( soooo many people do that now so i don't see it as that big a coincidence, though it still is fishy.

you really can't tell unless the artist decides to admit to it.

i am sorry that this has happened to you though :(

this is the kind of thing that will always happend in design/art field... I'm not sad or angry... its just uncomfortable :p
