ok, i love this! but the pipe is a direct rip from the old super mario bros game:

that being said, what exactly are the copyright rules regarding this kind of material? i would LOVE to do some nintendo-type shirts.

Uhm.

Not Super Mario, Regular Mario.

It's done in parody so it's legal but cannot be copyrighted.

watch them start whining about parodies, and it has been noted that his is a pixel perfect rip

What a day...

No, it's Super Mario Bros. The only non-super Mario game was "Mario Bros." and that was just that place where you fought against Luigi in the tubes to get 3 coins the fastest. There was the POW block in the middle...

Savvy?

just look at andy warhol or any other pop artist

there selling their paintings for thousands upon thousands of dollars

To say it's pixel perfect would be giving me to much credit. I did try my best to get it just like a mario pipe :)
tracerbullet
   tracerbullet on Jul 25 '06 at 11:52am
Then there was Super Mario Bros. 2, which was just a ripoff of Doki Doki Panic. Now that was a strange game, what with vegetables and all.

spires
   spires on Jul 25 '06 at 11:54am
just set up a grid in illustrator, import the pixel graphic and snap away, row by row.

It can be arduous, but it's a good way to get a perfect vector out of any old school pixel graphic

there's also more automated processes, but i don't feel like typing them out
UberRyan
UberRyan on Jul 25 '06 at 11:58am
you're like 10 days late, and like $15 short

parodys are not subject to copyright laws

nintendo doesn't give a shit

threadless is smart enough to know when and when not to print an obviously pre-used material, as long as they're aware of its prior usage.

Next time save blogspace and look at the design's blogs, previous to writing this one.

i'm not forcing you to read or comment to a blog i post. so put a sock in it. i'll do as i please.

whether parodies are legal is irrelevant to the issue of appropriation as an ethical debate

I vote yes to appropriation

and no to parodies as an convenient excuse for appropriation

if appropriation is right, context is irrelevant
little g
   little g on Jul 25 '06 at 12:13pm
none of my other subs are parodies. All the art on my website is mine. I am a legit artist with a long background in fine art, graphic design and publishing. I don't want to be judged in this way. Let's be fair here Spires. Why wont you let my shirt live in peace?

i don't care either way. i like the shirt. and i'd like to do some parodies myself. :D

appropriation would imply some sort of deception to the viewer
UberRyan
UberRyan on Jul 25 '06 at 12:16pm
dude... spires, loved disco, but give it a fucking rest

if your mario design had been printed your mouth would be shut and you wouldn't be saying one damn word. let her enjoy her fucking $2g's and get over yourself.

you've been here less than 3 months, you don't know about "that system"

and discord, any half-wit can do as they please, but someone of intelligence knows when and when not to as to avoid ignorance on their part.

none of you answered my points, just name called

and none of my last comments were comments about this design or Genee or Threadless, but comments about the law/legal system

so, read my posts before you respond, it may help

and Verdana is right, senority matters nothing here
UberRyan

senority however helps when trying to state your case. at this point no one is really taking you seriously.

There are a lot of things out there that use appropriation as a base. Do you have issue with Mezo? Her Fast Supper is a parody that appropriates logos of many fast food chains. I personally love it and have requested a reprint of it. Why are you focusing so much energy on me?
UberRyan

well you have to be about 8 to want to kick and scream and carry on, even after you've been shut down several times prior, in other blogs of the same subject. Its over kids, you lose, Genee' wins. Now bugger off.

NO. I support appropriation.

I don't support arbitrary legal categories, like parody.

I think what you have done with this design is fine, I have no problem with it. I just didn't like that you were complaining that someone else may have taken the idea from you, when your whole piece is based on appropriation. There is no distinction, other than some silly legal category.

That's my position.

UberRyan, I've never taken you seriously, but there's nothing wrong with that :)

Cheerlead onward!

UberRyan
UberRyan on Jul 25 '06 at 12:49pm
well its the shear fact that her design is a result of combining two sources, this person on a cafepress basically took that result and 86'd the damn man-eating flower

kept the positioning, the pipe, the spacing, shirt color, everything

that in any case is just cause to make a scene over. If I took your mario design, and maybe got rid of some random part of it, and posted it for sale on cafepress to turn a profit, you'd be pretty pissed too, wouldn't you? Right or wrong.
Kojima
   Kojima on Jul 25 '06 at 12:52pm
What the fool are you talking about Spires?

"just set up a grid in illustrator, import the pixel graphic and snap away, row by row.It can be arduous, but it's a good way to get a perfect vector out of any old school pixel graphic"

4 second method: Live trace, 1 pxel fittin, 0 blur, enlarge.
little g
   little g on Jul 25 '06 at 12:52pm
I never complained that someone else had the same idea as me James! Where did you read that? What I complained about was that someone accused me of ripping off that very person which I did not. My integrity was at stake. You would have done the same. Anyone would have. Thats why I posted my blog in the first place! I also said that the person who did the same shirt could have come up with the idea on his or her own. I gave them the benifit of the doubt. Please, can we just stop with this hole thing?! I am not about mud slinging or bashing. Like it or don't like it but show me some respect please. I never did anything to hurt anyone....
spires
   spires on Jul 25 '06 at 12:55pm

Little G, you must be doing something right. Your shirt is one of the highest selling shirts this week!
spires
   spires on Jul 25 '06 at 12:58pm
Little G, I don't know why this is making you upset. I am for parody, but I am not for the LEGAL CATEGORY of parody as a justification of appropriation. I think parody is funny and fine. I think appropriation is fine by itself, not needing the veneer of parody to justify it. By this standard, what you have done is just.

You said that it bummed you out, or it was a downer or something, and you went so far as to contact cafepress to ask if there was anything that could be done. I'm sorry if that does not qualify as complaining.

discord
discord on Jul 25 '06 at 1:03pm
BTW UberJackass.. when i posted this blog, the only other one i saw on the MAIN PAGE was regarding someone else on cafepress having the same shirt. after i read what that blog was about, i decided to post this, simply to ask about the copyright laws. I was not aware that you could do a parody, legally.. as I've seen some other shirt sites that do not allow this.

Get off your elitist high-horse.
