this doesn't sit well with me at all.

I LOVE this design. I think it's gorgeous. But I'm totally miffed by the rip off. Yeah, sure, it may not be direct copyright infringement since the design has been vectorized and tweaked, but it's definately not completely original.

I go to school for photography. Almost every day, I watch a makeup artist, a hair artist, a creative director, and a photographer put together an amazing look for an amazing photograph. They work hard to create the end product.

This design is using someone else's artistic creation for profit without giving any credit. It's really sad to see something that people put so much effort into being used without their permission or even knowledge.

I know alot of people disagree with me. that's okay.

But it is not the same as the photograph. He only used the pose as a reference. It's kind of the photographer of the original picture's fault for not getting complete copyright on the image.

Plagiarism is a heavy accusation. Do you have a link to the "original"?



This design is over two years old. Are you sure the art you think is being ripped off isn't the rip-off?

I think people need to get over it.



It's very different than the original.



It would be like saying that because I used a National Geographic photo as a reference for a painting is plagiarism, even though I removed the people and the mountains in the original photo.



Plus, this has been a design on threadless for awhile. The company that owns the original photo probably knows about it. I know that Threadless knows about it. They wouldn't have reprinted it if there was an issue.

i cant believe people can be so rude to someone who is just trying to inform us about something that is potential plagiarism. (mainly the first person who just went "shut up") i mean come on people, if youre going to criticize, you dont have to be an ass about it.



anyway, i totally see the resemblance. and if i were the person who originally designed it, i'd be pissed. but on the other hand i also agree with shampoosuicide, if anyone was going to sue or whatever, it would have been done already.

i dont like the idea of making money off a VERY popular picture as well. but meh. im just gonna "support" the disgust by not purchasing the shirt...



cos it seems like no matter how much you point it out.. somehow, just VECTORIZING someone else's image is very acceptable here on threadless :/ it's one very disappointing thing ive known here..



someone worked hard to make the photograph only to be vectorized and SOLD.. and made profit out of it. :/



I wish vector artists had a requirement of learning photography first before they just take something and trace and SELLLLLLLL it. i dont have an issue with personal use.. but SELLING it? come on :/

i dont think this is a very big issue...i mean yes the tracing of a photo has always been frowned upon and especially not advocated if it isnt even your photo to begin with.



i think that he changed the image enough and if he only used the pose from a photo that wasnt even copyrighted then there really isnt much harm. Besides there have been numerous straight up stolen art printed and paid for in the past, at least he didnt steal something without even changing it. Ive been here for awhile now, and ive been here when that artist participated regurally and all of his art was was very much his own.

I'm still going to buy it, it looks barely like the photograph, a vector is not a taken image. How do you know the designer traced it? maybe they just used it as inspiration.



Anyway... new bootiful tshirt for me :)

personally i dont see this as plagirism .... its not like the photo was just live traced like many designs are.... its used as reference to draw the girl... but maybe thats just me. i mean didnt ross use signs to draw his bike symbol? whats the difference. i dont know. i mean how should the photographer get full credit for this anyways, shouldn't the beautiful model in the shoot get some credit. or when a landscape picture is taken, than shouldnt the landscape architect get credit? its to hard to give credit for everything, and nothing is totally original, unless the photographer built that human being himself and put the make up on her too.



but maybe thats just me....

It is actually a form of plagiarism. Comic book artists have been reprimanded and even fired for doing "swipes"-- tracing photographs or still frames from films (it doesn't have to be an exact-match live trace). It is certainly frowned upon.



The beautiful model gets paid and signs a release to take care of any need for "credit".

It /is/ plagiarism. It would be just the same as restating someone's idea and not giving them credit in a formal paper.



Miyavi has been around longer than Threadless - this design definitely isn't the original.



But... even in saying that... gah. I want this shirt. "Look! MYV! A MYV SHIRT."

Psshhhhhhh whatever. This shirt KICK ASS either way. I love it! I'm an art student and taking someone's full design or using parts of it and making it your own are quite different from one another. Think about the famous artists who have done so: Duchamp and Picasso for example. I don't think Threadless would put out the shirt if it was such a problem (which I know has already been mentioned)

i really like it, and would buy it if i had any money. for the whole plagiarism debate, it saddens me that this design is marred by this debate, and it really saddens me that the girl in this shirt is actually a dude. im unfamiliar with Miyavi, so it kind of weirded me out for a bit

i keep checking back at this blog cuz its so interesting! haha. and i am wowed at what asnswerthatandstay said. just cuz you havent seen it before doesnt mean it doesnt exist..jeez people these days.



and WOW again at the link from minuku. maybe the same designer from threadless sent in the design? im unfamiliar with the site though, so i might be pulling stuff out of my ass. but i still stick with my original thought, if something was gona be done, it would have been done already.
