This happens all the time, I've done it, people have done it to my ideas, its just one of those things. Usually a quick search will reveal whether a design has been done before. I haven't used the search function on threadless for a while as it has been out of order since the new site.
Ideas do just get reused, rehashed and recycled, but I think as long as your idea has a fresh take on a concept and is technically different then theres not usually an issue.
This looks like a preparatory sketch. I can see that you can draw, but I think that this is lacking in concept. The characters aren't really interacting other than being next to each other. This would benefit from some kind of fun dialogue or odd misunderstanding and some kind of setting would have grounded the characters too.
I think you need to take a look at the sort of thing that Threadless prints regularly. The concept needs to be easy to read and preferably with a fun twist. Your second design isn't easy to read at all, the colours don't have enough contrast between them and merge unpleasantly and take time with your drawing, sketch your idea out many times before hand so that you get an idea about composition and the final design.
